Terms of Service

These terms are an agreement between you and TODO: company legal name for the FitendAi app and related services. Please read them, especially Health and safety.

Agreement

By creating an account or using FitendAi, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the app. If you use FitendAi for an organisation, you confirm you can accept these terms on its behalf.

Who can use the app

You must be at least 13, or the minimum age of digital consent where you live if that is higher. If you are under the age of majority, a parent or guardian must agree to these terms for you.

Your account

  • Give accurate information and keep it up to date. Body data such as weight affects calorie estimates.
  • Keep your password safe. You are responsible for activity on your account.
  • Tell us straight away at TODO-support@your-domain.com if you think someone else has accessed it.
  • You can delete your account at any time. See Delete your account.

Health and safety

FitendAi is a fitness app, not a medical device, and it doesn’t give medical advice. Jump rope training is vigorous exercise.

  • Talk to a doctor before starting a new exercise programme, particularly if you are pregnant, have a heart, joint or other medical condition, or haven’t exercised in a while.
  • Stop straight away if you feel pain, dizziness, faintness or shortness of breath, and get medical help if needed.
  • Train in a safe space with enough room overhead and around you, on a suitable surface, with appropriate footwear.
  • Jump counts, pace, calories, heart rate and stability scores are estimates. They depend on your device, sensors and body data, and shouldn’t be relied on for medical decisions.
  • Rope Battles are a game. Don’t push past your limits to win.

You use the app and do the exercises at your own risk, to the extent the law allows.

AI Coach

The AI Coach uses artificial intelligence to generate replies, weekly reviews and interval plans from your training data. AI output can be inaccurate, incomplete or unsuitable for you. It is general fitness information, not medical, physiotherapy or nutrition advice. Use your own judgement, and check with a professional before acting on it if you have any health concerns.

Don’t use the AI Coach to create harmful, illegal or abusive content, or to try to get around its safeguards. Your plan may limit how often you can use it.

Smart ropes and devices

FitendAi works with compatible smart jump ropes and with your phone’s motion sensors. Hardware is sold and warranted by its manufacturer, not under these terms. We don’t guarantee that every device, phone or operating system version is compatible, or that connections are uninterrupted.

Subscriptions and payments

Some features may need a paid subscription. If you subscribe:

  • You buy it through the App Store or Google Play, and their terms apply to the payment. The price, billing period and any free trial are shown before you confirm.
  • Subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your account is charged within 24 hours before renewal.
  • Cancel or manage your subscription in your App Store or Google Play account settings. Deleting the app or your FitendAi account doesn’t cancel it.
  • Any unused part of a free trial ends when you buy a subscription.
  • Refunds are handled by Apple or Google under their policies. Nothing in these terms limits refund or cancellation rights you have under consumer law.
  • We may change what a plan includes or its price. Price changes apply from your next renewal, and the store will tell you beforehand when its rules require it.

We may also give plans for free or as a promotion. These can end on the date we told you, or with reasonable notice.

Acceptable use

Don’t:

  • use a display name or photo that is offensive, impersonates someone, or infringes someone else’s rights;
  • harass, threaten or spam other users, including through friend requests and battle invites;
  • cheat on leaderboards or in battles, for example by faking sessions or tampering with the app or devices;
  • reverse-engineer, scrape, overload or interfere with the app or its servers, except where the law allows;
  • access another person’s account, or use the app for anything illegal.

Your content

You own what you add to FitendAi, such as your display name, photo, interval plans and messages. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy and display it only as needed to run and improve the service: for example, showing your name and photo to your friends. The licence ends when you delete the content or your account, except for copies in backups until they are overwritten. We may remove content that breaks these terms.

Our app and licence

The app, its design, workouts, text, graphics and software belong to TODO: company legal name or its licensors. As long as you follow these terms, we give you a personal, non-transferable, non-exclusive, revocable licence to use the app on devices you own or control, for your own non-commercial use. If you send us feedback, we may use it without owing you anything.

Third-party services

The app connects to services we don’t control, such as Sign in with Apple, Google sign-in, Apple Health, Health Connect and your device’s operating system. Their own terms and privacy policies apply to your use of them.

Apple and Google

If you downloaded FitendAi from Apple’s App Store:

  • These terms are between you and TODO: company legal name, not Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that it infringes someone’s intellectual property. We are responsible for investigating and handling those claims.
  • You confirm you are not in a country under a U.S. Government embargo or on a U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded the app from Google Play, Google Play’s terms also apply to your download and purchases.

Suspension and termination

You can stop using FitendAi and delete your account at any time. We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires us to. Where reasonable, we’ll tell you why and give you a chance to respond. We may also change or stop parts of the service; if we stop the app entirely, we’ll give reasonable notice. Sections that by their nature should continue, such as disclaimers and limitation of liability, continue after termination.

Disclaimers

To the extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy of measurements or AI output, and uninterrupted or error-free operation. Some places don’t allow these exclusions, so they may not all apply to you.

Limitation of liability

To the extent the law allows, TODO: company legal name won’t be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim, and 50 US dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that can’t be limited by law, and nothing affects your statutory rights as a consumer.

Indemnity

If you use the app in breach of these terms or the law, and that leads to a claim against us, you agree to cover our reasonable losses and costs, to the extent the law allows. This doesn’t apply to consumers where local law doesn’t permit it.

Governing law

These terms are governed by the laws of TODO: country / state of governing law, and its courts handle disputes, except where your local consumer law gives you the right to bring a claim where you live or to rely on its mandatory protections. Please contact us first; most issues can be sorted out quickly.

Changes to these terms

We may update these terms. We’ll change the date at the top, and for significant changes we’ll tell you in the app before they take effect. If you keep using FitendAi after that, the new terms apply. If you don’t agree, you can delete your account.
